Why and how alcohol testing is used in Family Court

In cases where alcohol dependency is suspected, the court may request alcohol testing to assess whether a parent is fit to maintain custody or visitation rights.

Where a single test may not provide sufficient evidence of long-term sobriety or reduced alcohol consumption, repeat alcohol testing can be used to monitor alcohol consumption over time, ensuring the tested individual remains sober and compliant with court orders.

This is especially useful in circumstances cases where there is a history of alcohol dependency or relapse, allowing the court to determine if a parent or guardian is fit to maintain or regain custody.

What are the different types of alcohol test for Family Court?

Alcohol tests that can be used to obtain evidence for Family Court include:

  • Hair Alcohol Testing: tests for historic chronic and excessive consumption or abstinence, using head or body hair.

    Hair alcohol testing can determine historic alcohol consumption but cannot be used to identify recent or short-term consumption.

    Head hair can provide insight into alcohol consumption for a period spanning 1-6 months. Body hair can provide insight into alcohol consumption for a period of up to 12 months.

  • Blood Alcohol Testing: tests for historic chronic and excessive consumption or abstinence using a blood sample.

  • Nail Alcohol Testing: tests for historic chronic and excessive alcohol consumption or abstinence using nail clipping samples.

    Fingernail clippings provide an overview of up to 6 months for alcohol consumption, while toenail clippings provide an overview of up to 12 months.

  • Breath Alcohol Testing: used for more immediate detection of alcohol consumption, breath testing provides a snapshot of a person’s current breath alcohol levels. It is useful for on-the-spot testing, especially if there is concern that a parent/guardian may be under the influence during a visit or custody exchange.

  • SCRAM CAM®: the SCRAM CAM provides real-time, continuous monitoring using an ankle bracelet that detects traces of alcohol in sweat.

    The tamper-proof bracelet can be worn on the ankle for as long as required, allowing the court to gain insight into a participant’s drinking activities over a defined period.

    Repeat testing provides clear, documented evidence of compliance, showing whether or not the parent is adhering to the court’s orders.
